Freshman Marcus Banducci was arrested April 7 at Gessner Hall on a felony charge of possession of marijuana with attempt to distribute, according to a Douglas County District Court official.
Later that day, university officials and law officers searched six rooms in Gessner and the New Living Center.
Dean of Students Cassy Bailey said representatives of three law enforcement agencies met her that morning and Bailey and Associate Dean of Students Teresa Clounch went with the officers to Gessner, where they met Banducci in his room.
At that time, the Kansas State Highway Patrol arrested Banducci. He was released from the Douglas County Jail on a $5,000 bond and is scheduled to appear in Douglas County District Court at 3 p.m. April 21, when he will be formally charged.
Bailey said during room searches, items were found that violated the university’s alcohol and controlled substance policy. However, no further arrests were made.
Bailey said the need for additional room searches “came from information that we may have controlled substances in our living environments. … We got that from local law enforcement and other sources.”
Banducci also faces possible consequences with the university, but Bailey could not comment as to what those consequences might be.
“I would caution the students to know that in the student handbook it is clear that the university at any time can do a room search of rooms on the property, on Baker’s property,” Bailey said.
However, Bailey said searches are not routine.
“My office deliberately chooses not to do random searches unless we feel like there is just cause for such things,” Bailey said.
Banducci did not return calls seeking comment.
